North Carolina Laws on Rental Application Fees

  There is no upper limit or maximum rental application fee that a landlord may charge a potential tenant in North Carolina. Although it's recommended to not charge more than the typical out-of-pocket price, the landlord ultimately has the last say in how much to charge.

According to North Carolina state law, a landlord may request a security deposit if a prospective tenant's application is approved. The most a landlord may demand as a security deposit is two months' worth of rent for leases that are longer than month-to-month. The maximum is one and a half months' worth of rent if the lease is month-to-month. The maximum is two weeks' rent if the lease is week-to-week.

  All security deposits must be kept in a trust account.

Processing a Rental Application

  

The information on the rental application form will be used to do a background check as the following stage in the tenant screening process:

  • Credit Check- With the tenant's written authorization, a credit check will either produce a straightforward "pass/fail" report or a comprehensive credit report that includes the tenant's credit score as well as details on their income, job, previous addresses, credit inquiries, and more.
  • A tenant's history of eviction files or judgments against them over the course of the previous seven years is revealed by an eviction check.
  • Criminal History Check- A criminal history check tries to reveal any records concerning the renter in databases
